These Terms & Condition act as an acceptance agreement between Car and Cab and user or all visitors

or others who access, download, register and use the services of Car abd Cab website/application.

IF YOU DISAGREE OR DIFFER TO BE BOUND BY ALL TERMS & CONDITION MADE AVAILABLE ON CAR AND CAB WEBSITE/APP PLEASE DO NOT USE APPLICATION/WEBSITE OR ANY SERVICES OF CAR AND CAB.

2-Intellectual property rights

www.carandcab.com is owned and managed under copyright act by Car and Cab.

Car and Cab owns All Intellectual property rights unless until contain anything

Unfavorable or any material related to any third party. Such as

Graphics, design, copyright, related rights, trademark, trade name, service\marks, database images, logo or all right on car and cab website/App. you shall not Download/reuse or copy any material from car and cab website/App.

This kind of act is not allowed without permission of Car and cab or in written consent form of Owners/Directors.

If Car and cab find anything suspicious or unauthorized /any one indulge in such activity than Car and cab can take appropriate legal action against the same including without limitation,Civil, criminal or related with. Any updation in terms and condition or in privacy policy Will come under immediate effect right after posting on Website/App. By accepting to these terms and Condition user/working partner are agreed to periodically review and changes in terms and condition as Required by company or to provide hassle free services/platform to our users or working partners.

Car and cab have all the right reserved related to any changes or modification in these terms.

The Car and cab is a service provider platform (web/app) .platform is managed and operated by Car and cab through its representatives.

4-USE OF Car and cab SERVICES (web/App)

As per the provisions of this Information Technology Act, 2000 and being presented in electronic form, can Be presented as electronic devices and apply as electronic recorders, as per any proposed proposal or any Amended provisions. No physical or digital signature required in this electronic form of “term & condition”.

Document related to Car and cab “term & condition” are being posted and published on Car and cab website (www.carandcab.com)and App (mobile application) As per the provision of Rule 3 (1) of the Information Technology Act 2011.

5- USER

Index B of these terms of use describe definite terms & condition which are applicable to our user/customer/you/your or any person registering with Car and cab website (www.carandcab.com).

. Any person/individual using services of car and cab on renting vehicles is considered as user/customer/you/your.

. Users booking will be confirmed once they have paid for the choosen rental period and vehicle.After confirmation of booking user have to follow these terms and follow the agreement, in case of any violation of these terms & condition by user in any way the car and cab have all the right to cancel the booking and barred the user's services on car and cab platform without any prior notification.

. Car and Cab have all the right to decline the registration of any individual or person as a user without any reason.It is also clarified that in such an event,if a person is rejected to register as a user than he/she can not avail any service of car and cab or rent any vehicles from car and cab.

6-Register As a User

By accepting these terms, you are agreed to bound by following:

During the registration on web/app ,you may asked for your personal information, contact detail ,address, location or any service related information to provide you service at your door step by car and cab/working partner available in your area. You must ensure about the information you are providing are correct, proper and not confusing at the time of booking/registering for services. you have to inform us if you are updating any information what you have provided at the time of booking, so we can establish a communication for frequent and hassle free services.User can not hold multiple account on car and cab platform if he/she found to do so than car and cab have all the rights to cancel his/her registration without any prior consent.

In terms of use of service you must obtain and register a account. for register a account you must be at least 21 years of age or legal according to jurisdiction. to register a account you may have to share few details with Car and cab like-

A.name, contact detail, address, e mail etc to give you service at right time and right place.

B.Valid driving license (copy)

C.Debit/credit card detail,if required foe payment purpose

D.Residential proof I'd or any other required document asked by car and cab or it's representatives.

.Use of Car and cab services/website/App available/provided by Car and cab platform is only to individual/persons who can inter into legally binding contract as per the Indian Contract Act 1872.

Individual who are” incapable to contract” by the meaning of Indian contract Act 1872 if minors, you are not qualified to use the services/website/App .

if you are under the age of 18,you are not qualified to register or transact as a user/individual of website/App and or use any services on Car and cab platform.

If any of the information you provide is found to be inaccurate, you will act to compensate for any harm or loss of Car and cab, and consider car and cab or it's representatives to be harmless to any third party or civil or criminal claim.

7--User management

Car and cab does not share your data/detail with anyone in anyway.

To use any services on Car and cab platform through Car and cab website/App,It is necessary to register your account on our Website/App.

at the time of registration you will receive a OTP to login via telephonic device, you will receive an OTP every time you logged in.

You are responsible for confidentiality of your OTP and account, and also fully responsible for activity on your account. if anything suspicious or security breach or any data loss in anyway related to account you are using, you are fully responsible for it, Also You shall have to notify to Car and cab for the same.

Personal Details

While registering on car and cab platform or using services of car and cab you may be ask to submit valid documents for renting a vehicle.

During registration on car and cab platfiorn you may have upload a scanned copy of valid driving license and other documents authorized /issued and validated by government of India such as Aadhar card,Passport,Driving license etc.

user may have asked for his/her photograph and other valid documents by car and cab associates/representatives for varification process/proof to avoid any fraud or theft.

The documents and pictures will be used for address varification and identification purpose and can not shared with any third party.

Booking is valid only upon varification of user's documents.In case of documents not matching details,address or other information than car and cab have rights to cancel the registration of user.

if user will failed to show hard copy(original documents) to car and cab associated/reperesentatives/drivers at the time of car pickup than this booking will stand cancel as user is failed to varify the document. and the vehicles's rental/possession won't be given to user.

8-Security and password management

You acknowledge to immediately inform to Car and cab if any unauthorized use or any third party interference into your account without your authorization.its your sole responsibility to keep your account safe and do not share your personal detail with any third party or with unknown platform.in this regards you shall have take a note on below points-

(i) In case of any suspicious use of your account (immediately inform to Car and cab)

(ii) In case of any security breach(immediately inform to Car and cab)

(iii) make sure to exit from your account after completion of service

(iv) Do not share your OTP with other in order to keep your account safe

9- Use of services to users/customers

Along with choosing and using any of Car and cab services, you also have certain obligations as a customer.

1-While rendering services, you cannot force the drivers to do any such work which is not under the working procedure of company terms.

2-You/your/family members or any other member present with you cannot in any way, physically or mentally harass/misbehave or use false/abusive language or shall not use any violence with our drivers/coordinators,which is unacceptable and illegal.

3-you will be responsible for making full payment of all those services availed by you as per the invoice, which will contain the value of the service, the fixed taxes, the value of the goods and other(if any).

4-You will also have to ensure that there is no any kind of misuse or damage of vehicle at the time car rental period in any way.

5-in case of unsatisfied with our services or for any kind of suggestions, kindly go to our "contact us" column on website/App, we will contact you within 24 hours after lodging a complaint/suggestion.

6-car and cab or it's reperesentatives can cancel or reschedule the services requested by customer for any reason, you can contact to us in this regard if getting any problem related to your services.

7-if customer find out any wrongdoing by Driver/coordinator in anyway ,in that regard customers are advised to inform Car and cab for the same in writing within 24 hours of availing the services of Car and cab.

8-it is advised to all our customers that take care of all your belongings at the time rendering the service by Drivers during your rental period.

9-if customer find anything missing, loss,left inside vehicle post availing the services, it is advised to customers to inform Car and cab within twenty four (24) hours of availing the service, Car and cab will try and give its best effort to find out or enquire about the missing, loss or left inside vehicle, but Car and cab will not be responsible for the same missing or loss.

Cancellation & Modification Before Trip

In case of any service booked by customer and made the payment for the same, customer will get website/app generated invoice with all details.

In case of service cancellation by customer, service charges have been paid, customer will receive a sms and cancellation receipt on website/App.

Refund process will initiated for the designated bank of customer.

Refund procedure may take up to 14 days from cancellation date, depending upon customers bank rules (after confirming those services and related payment transaction).

though our flexible cancellation and modification policy gives you freedom to modify your booking before start of trip depending on remaining time.

1-24 hours or more prior to start time:

Rs 500 will be charged for cancellation and rest amount will be refunded to you.

2-From 24 hours to 2 hours prior to start time:

40% of base fare price will be charge and rest amount will be refunded to you.

3-Within 2 hours of trip start time:

100% of base fare price will be charged to you with delivery charge(if any) and rest amount will be refunded to you.
